States Medical
Center, a Nevada
District Court agreed,
and the Ninth Circuit
Court of Appeals
(covering 9 western

entire law unconstitu-
tional, not just the
advertising portion.
And eventually the
Supreme Court
upheld the decision
regarding advertising,
but, confusingly, did
not comment on
whether the rest of
the law could remain
in force.
In the opinion, the
Supreme Court sug-
gested that Congress
devise a better way to
